These Terms of Use ("Terms") govern your access to and use of the Tree Safety Institute platform, including the application at app.treesafety.org and the marketing website at treesafety.org (collectively, the "Platform"), operated by Tree Safety Institute, LLC, a Missouri limited liability company ("we," "us," or "our"). By creating an account or accessing the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
Account creation. To use the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at admin@treesafety.org if you suspect unauthorized access to your account.
Company accounts. If you register on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and the terms "you" and "your" apply to that organization.
Minimum age. You must be at least 18 years old to create an account. Employer accounts may grant access to employees who are minors only where permitted by applicable law and with appropriate employer oversight.
Free plan. We offer a free tier with limited features and a maximum of 10 employees. Free plans are provided as-is with no guarantee of continued availability.
Paid plans. Paid subscription plans (Pro and Business) are billed monthly on a recurring basis through our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Trials. Trial periods, where offered, convert to paid plans at the end of the trial unless cancelled. We will notify you before conversion.
Cancellation. You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a billing period.
Price changes. We may change subscription pricing with at least 30 days' notice to the email address on your account. Continued use after a price change takes effect constitutes your acceptance of the new pricing.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:
Content license. We grant you a limited, non-exclusive, non-transferable license to access and use the training content on the Platform solely for the internal training and compliance documentation needs of your organization during the term of your subscription.
Accuracy. We make reasonable efforts to ensure training content is accurate and aligned with current industry standards. However, standards change. You are responsible for verifying that your safety program meets all applicable regulatory requirements. See our Disclaimers & Limitations.
Certificates. Training certificates issued through the Platform are records of completion of online training modules. They are not professional certifications, licenses, or endorsements by any regulatory body or standards organization. Certificate authenticity may be verified at treesafety.org/verify.
Your data. Training records, certificates, incident reports, and other data you enter into the Platform remain yours. We do not claim ownership of your organization's data.
All content on the Platform — including course materials, toolbox talks, design, software, and trademarks — is the property of Tree Safety Institute, LLC or its licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you except the limited license described in Section 4.
ANSI Z133 is a standard published by the American National Standards Institute. Tree Safety Institute is not affiliated with, endorsed by, or a licensee of ANSI or the Tree Care Industry Association (TCIA). Our training content is independently developed and aligned to the publicly available standard.
By you. You may close your account at any time from your account settings. On closure, your access to the Platform terminates immediately. We retain your data for 90 days following closure, after which it may be deleted.
By us. We may suspend or terminate your account if you violate these Terms, fail to pay amounts owed, or if we determine that continued access poses a risk to the Platform or other users. We will provide reasonable notice where practical.
Effect of termination. Upon termination, your license to use the Platform ends. Sections that by their nature should survive termination (including Sections 5, 7, 8, and 9) will survive.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TREE SAFETY INSTITUTE, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, BODILY INJURY, OR PROPERTY DAMAGE — ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $100.
These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts.
Before initiating any formal legal proceeding, we ask that you contact us at admin@treesafety.org to attempt to resolve the dispute informally.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify account holders by email at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.
